Three face mortgage fraud charges

A Leawood mother and her two daughters face fraud-related federal charges following their arrests last week in connection with practices involving an Olathe business.

Doris Toledo, 67, and daughters Sonia Toledo, 38, and Sylvia Toledo, 42, each face 11 felony counts of computer fraud, 11 felony counts of making a false writing and one count of felony theft in Johnson County.

Their allegedly fraudulent mortgage loans totaled $7.7 million and generated about $128,000 in loan origination fees and $228,000 in real estate commissions, the state alleges.

The indictments also allege the Toledos guided illegal immigrants to use false documents to get Social Security numbers needed to obtain loans to buy houses.

The Customs Enforcement office of Investigations, Kansas City, Mo., will go on combatting such document fraud, Sheila M. O'Neill said. She is the assistant special agent in charge of the Immigration and Customs En-forcement Office of Investiga-tions.

“ICE will continue to work closely with our many law enforcement partners, and to use our unique immigration and customs law enforcement authorities, to help secure these vulnerabilities,” O'Neill said.

At the HUD Office of Inspec-tor General, Special Agent in Charge Phyllis Grissom-Rob-inson said the case should be a warning to would-be criminals.

“This investigation will help send a strong message that those who seek to unlawfully profit by defrauding FHA loans in HUD will be vigorously prosecuted,” Robinson said.

Based on the investigation, the Johnson County District Attorney's Office alleges that in April 2005, a routine Federal Housing Administration audit uncovered stolen Social Security numbers used to process about 108 mortgage loans out of Building and Loan Mortgage Co., Olathe. Audit results went to the Department of Housing and Urban Development's Office of Inspector General, which began a formal investigation.

At various times during the investigation, Immigration and Customs Enforcement and the Secret Service agents participated in the investigation, which resulted in the charging or arresting of 30 people who are alleged illegal aliens.

If convicted as charged, each Toledo faces up to 18 months in prison. Sentences would run concurrently, not one after the other, the Johnson County District Attorney's Office reported.

Johnson County Assistant District Attorney Pat Carney presented the case to the grand jury Aug. 14. The grand jury returned indictments.
